Mr. Tory – That the Standing Committee on the Legislative Assembly shall meet for the purposes of an inquiry. The terms of reference of this inquiry include but are not limited to: an investigation into the flow of information between the Ontario Lottery and Gaming Corporation, the Minister and Ministry of Public Infrastructure Renewal and the Premier's Office regarding the issues of fraud and other irregularities within Ontario's provincial lottery system, including documentary and viva voce evidence, and a review of the actions taken and the actions which might more appropriately have been taken to protect the interests of the citizens of Ontario and restore their faith and confidence in the integrity of Ontario's lottery system;

That the Committee for the purpose of this referral is to be chaired by a member of the Official Opposition;

That the subcomittee of the Committee be composed of one representative from each party plus the Chair;

That the subcommittee shall have the ultimate decision-making power with respect to the calling of witnesses and any other procedural aspects of the proceedings and all matters arising relevant to the execution of the terms of reference of the Committee. A minimum list of witnesses will be determined by the House Leaders; additional witnesses to be determined by the subcommittee;

That there shall be a Committee counsel hired and directed by the subcommittee paid for by the Legislative Assembly;

That the subcommittee can through Speaker's warrant compel the attendance of any person to attend and give evidence;

That the subcommittee can through Speaker's warrant require any person to produce in evidence such documents and things as the subcommittee may specify;

That the members of the Committee and/or their counsel shall be permitted to obtain production and review of any document or thing and disclosure of any viva voce evidence necessary and ancillary to the purpose of this investigation;

That prior to the commencement of the Committee hearings the subcommittee may require the attendance of any person or production of any document for the purpose of a preliminary examination for discovery;

That the Legislative Assembly Committee has priority over all other Committees with respect to its sitting time and in any event, the Committee shall not sit as a Committee for the purposes of this matter prior to the 1st day of May, 2007. The Committee shall complete its investigation and file its report on this matter no later than the 30th day of June, 2007;

That the Legislative Assembly Committee be authorized to meet at the call of the Chair and notwithstanding prorogation;

That any witness compelled to appear before the Committee may attend with counsel and shall be required to give testimony upon oath pursuant to section 59 of the Legislative Assembly Act; and

That the Committee may if requested permit any portion of its proceedings to occur in camera. Addressed to the Premier of Ontario.

Mr. Wilson – That, in the opinion of this House, the Ontario Liberal Government should provide Stevenson Memorial Hospital with the required $1.4 million in new funding over the next three years so that it can re-open its birthing unit and ensure that enough obstetricians and health care providers can be recruited to supply a stable and ongoing service for expectant mothers in New Tecumseth, Adjala-Tosorontio and Essa.

3. Mr. Tory – That the Standing Committee on the Legislative Assembly shall meet for the purposes of an inquiry. The terms of reference of this inquiry include but are not limited to: an investigation into the flow of information between the Ontario Lottery and Gaming Corporation, the Minister and Ministry of Public Infrastructure Renewal and the Premier's Office regarding the issues of fraud and other irregularities within Ontario's provincial lottery system, including documentary and viva voce evidence, and a review of the actions taken and the actions which might more appropriately have been taken to protect the interests of the citizens of Ontario and restore their faith and confidence in the integrity of Ontario's lottery system;

       That the Committee for the purpose of this referral is to be chaired by a member of the Official Opposition;

       That the subcomittee of the Committee be composed of one representative from each party plus the Chair;

       That the subcommittee shall have the ultimate decision-making power with respect to the calling of witnesses and any other procedural aspects of the proceedings and all matters arising relevant to the execution of the terms of reference of the Committee. A minimum list of witnesses will be determined by the House Leaders; additional witnesses to be determined by the subcommittee;

       That there shall be a Committee counsel hired and directed by the subcommittee paid for by the Legislative Assembly;

       That the subcommittee can through Speaker's warrant compel the attendance of any person to attend and give evidence;

       That the subcommittee can through Speaker's warrant require any person to produce in evidence such documents and things as the subcommittee may specify;

       That the members of the Committee and/or their counsel shall be permitted to obtain production and review of any document or thing and disclosure of any viva voce evidence necessary and ancillary to the purpose of this investigation;

Special Debates – WANT OF CONFIDENCE

Mr. Runciman That, in the opinion of this House, since the Premier has failed to ensure the highest level of integrity for his ministers, and that, while under a cloud of scandal, his government as a whole is sorely lacking vision and any real plan to deal with the urgent issues facing Ontarians and their pocket books, the government no longer has the confidence of this House. Filed on October 13, 2005.

Mr. Tory – That, in the opinion of this House, due to the Premier's weak leadership in dealing with the Caledonia issue and his refusal to even acknowledge the severity of the issue by consistently trivializing the 100-plus days of occupation as having passed "without incident";

And, due to the fact that the McGuinty government has abandoned its own clear-cut conditions precedent for the negotiation talks to resume;

And, due to the injury of 16 OPP officers and the irrefutable damage caused to the image and reputation of the OPP – Ontario's respected police force upon which Ontarians depend to maintain law and order in this province, and for which the McGuinty government is ultimately responsible;

And, due to the fact that the McGuinty government has placed itself in a weak negotiating position and has set a potentially dangerous precedent by purchasing the land while it continues to be occupied by parties subject to a court order which has not been complied with;

And, due to the fact that the McGuinty government has further weakened its negotiating position by resuming negotiations while a majority of suspects named in arrest warrants remain at large (including one wanted for attempted murder of an OPP officer), contrary to Premier McGuinty's own conditions;

And, due to the McGuinty government's refusal to uphold the rule of law as it applies to all residents of Ontario without exception;

7.    Mr. Wilson – That, in the opinion of this House, the Government of Ontario should start a campaign to educate the public about Bill 191, Highway Traffic Act Amendment Act (Emergency Vehicle Safety), 2002, that requires motorists to slow down and, where possible and safe to do so, move to a lane not adjacent to the one in which an emergency vehicle is situated to protect police officers, firefighters and other emergency personnel whose vehicles are stopped on the shoulder of the province's roadways with the red lights flashing. 10.  Ms. Horwath – That, in the opinion of this House, the Ontario Liberal government refuse to allow garbage from the Greater Toronto Area to be brought to Glanbrook Landfill site or anywhere in the City of Hamilton without authorization of a majority of members of Hamilton City Council and/or a referendum of Hamilton residents. Filed on December 14, 2005.

12.  Mr. Arnott – That, in the opinion of this House, the Government of Ontario should establish a fund to support the families of first responders, such as fire fighters, police officers, paramedics, and medical personnel, who lose their lives in the line of duty, providing a benefit of at least $500,000 to the families of these fallen heroes. 17.  Ms. Horwath – That, in the opinion of this House, the Government of Ontario should urge the Government of Canada in the strongest possible terms to reconsider its refusal to protect and enhance progress on child care and should uphold the 2005 negotiated agreements on early learning and child care; and

       That the Government of Ontario should honour its commitment to new, annual provincial funding to create new child care spaces in Ontario, beyond those targeted to be in place by September 2006, by investing the $300 million it promised in 2003 to expand the high quality provincial program of accessible, affordable, regulated and licensed, not-for-profit child care. 18.  Mr. Arnott – That, in the opinion of this House, to enhance the role of the Private Member, and allow for the debate of more Private Members' Ballot items, the Standing Orders should be revised as follows:-

20.  Ms. MacLeod – That, in the opinion of this House, the Government of Ontario take a leadership role in working with the Rideau Valley Conservation Authority and the City of Ottawa in order to ensure the historic site of Dickinson Square remain under the auspice of public ownership and management. 21.  Ms. Horwath – That, in the opinion of this House, the Minister of Labour should direct the Workplace Safety and Insurance Board to establish a joint trusteeship model for the governance of the Workplace Safety and Insurance Board (WSIB) Pension Plan and, accordingly, make it clear that the Government of Ontario expects the implementation of joint trusteeship to be considered in the context of any review of the WSIB Pension Plan. 22.  Mr. Tabuns – That in the opinion of this House, to ensure equal treatment of co-mothers, as ordered by Justice Rivard, the Government of Ontario immediately proclaim the amended Section 9 of the Vital Statistics Act, relating to Certification of Birth, which reads:

       'The mother and father, or either of them, in such circumstances as may be prescribed, or such other person as may be prescribed, shall certify the birth in Ontario of a child in the manner, within the time and to the person prescribed by the regulations.',

       and via regulation, identify co-mothers as persons who can certify a child's birth. Filed on June 21, 2006.

25.  Ms. DiNovo – That, in the opinion of this House, the Government of Ontario should immediately end the clawback of the National Child Benefit Supplement from all families in Ontario. Filed on October 2, 2006.

26.  Ms. DiNovo – That, in the opinion of this House, the Government of Ontario should immediately commence construction of not-for-profit rent geared to income housing units in order to keep its election promise of building 20,000 units; and begin to meet the housing needs of the 122,000 Ontarians on waiting lists for affordable housing. 28.  Ms. Horwath – That, in the opinion of this House, the Government of Ontario should urge the Federal Government to restore the $5 million (40 per cent) cut to Status of Women Canada (SWC), which is a vital government agency for women's rights, opportunity and equality. 35.  Ms. DiNovo – That, in the opinion of this House, the property tax rate levied by the Province on small business should be applied more equitably across the Province, and the tax rate for small business should be set at the same rate for the entire Greater Toronto Area, and that level of taxation should be frozen. To mitigate municipal costs, an uploading of the downloaded cost for social programs (excluding education) should be assumed by the Province on a phased in basis over 10 years. 36.  Mr. Tory – That, in the opinion of this House, the Government of Ontario, pursuant to Section 10 of the Fiscal Transparency and Accountability Act, 2004, should bring forward a regulation that, with all party consent to the exact wording of the regulation:

· Establishes a deadline for the release of a pre-election report no later than 6 months in advance of October 4, 2007 (the "Election Date").

· Provides sufficient time for the Auditor General to receive all necessary information and materials to allow him to conduct the pre-election review, but in no case shall this information be received by the Auditor General later than 7 months prior to the Election Date.

· Requires the Auditor General to render an opinion on the reasonableness of the fiscal plan for a period of no less than 3 years and enables him to comment on the reasonableness of economic assumptions, revenue assumptions and spending assumptions as presented in the most recent fiscal plan.

· Allows the Auditor General full access to any and all documentation he deems necessary to conduct his review effectively and to meet the intent of the legislation, including but not limited to:

Any and all Ministry Results Based Planning Submissions detailing spending and program requests, risks and mitigation strategies for those risks.

Any and all documentation required from any and all hospitals, school boards, community colleges or other organizations whose accounts are consolidated with those of the Province of Ontario.

· Ensures the Auditor General defines the level of materiality going forward in his report; and

· Provides for appropriate funding for the Auditor General to conduct his review and enables the Auditor General to retain external support as required to conduct this review within the time period allocated. Filed on December 13, 2006.

37.  Mr. Kormos – REASONED AMENDMENT – That the motion for Second Reading of Bill 173, An Act to amend the Legislative Assembly Act, the MPPs Pension Act, 1996 and the Executive Council Act be amended by deleting all the words after "That" and substituting therefore the words: "That this Bill be NOT now read a Second time but be referred back to the Government with instructions to incorporate therein:

1. the principle that the base salary of Members of this Legislature be determined with a view to the interests of all Ontarians and not all Canadians; and

2. the principle that the base salary of Members of this Legislature be determined by reference to the minimum wage generally prevailing in Ontario from time to time." Filed on December 14, 2006.

38.  Ms. DiNovo – That, in the opinion of the House, the Government immediately implement Status of the Artist legislation including labour standards and taxation measures to improve the working lives of artists in Ontario including: Protection for child performers; access to training and professional development programs and funds; tax measures such as income averaging and/or exclusions of certain incomes from provincial taxes and protection for senior artists, and that the Government engage in a consultative process leading to the creation and enactment within 24 months of an appropriate labour relations mechanism encompassing a collective bargaining procedure for all professional artists and producers/engagers in the Province of Ontario. 40.  Mr. Prue – That, in the opinion of the House, with respect to access by persons with disabilities, the Democratic Renewal Secretariat and the Ministry of Municipal Affairs and Housing should immediately undertake a thorough review of the Elections Act and the Municipal Elections Act and other relevant regulations, policies, practices and funding, such review to consider:

       a) the reasons for denying funding access and accommodations for persons with disabilities who are deprived of their democratic right to be involved in the democratic and election processes as candidates, volunteers and electors;

       b) The current regulations, policies and practices for funding guidelines for equal participation for persons with disabilities under the Elections Act and the Municipal Elections Act;

       c) the availability of awareness training on access and accommodations for staff and volunteers in Elections Ontario and Municipal offices to ensure equal access for persons with disabilities who wish to participate in accessible democratic and electoral processes;

       d) the availability of funds for the costs of access and accommodations for persons with disabilities who participate in the electoral process, accessible all-candidates meetings and election campaign activities (i.e.: accessible election campaign offices and accommodations for candidates and volunteers with disabilities);

       e) the appropriateness of the currently limited mandates of the Ministries of Community and Social Services (i.e.: Accessibility Directorate), Democratic Renewal Secretariat (i.e.: Election Act), and Municipal Affairs (i.e.: Municipal Elections Act), to assist those who need access and accommodations services, and the policies and regulations of those ministries on the provision of those services, particularly to funding of one fully accessible all-candidates debate per electoral riding, ensuring level access, technology and interpretation services (American Sign Language or langue des signes québécoise and real-time captioning), providing information on the electoral process and details on Elections Ontario and Municipal Elections programs and services for disable electors (i.e.: this information would be supplied by Elections Ontario and Municipal clerks for Municipal Elections) and determining funding that would be provided only for events conducted in a politically neutral fashion; and

       f) such other matters that ministries consider necessary to complete a thorough evaluation of provincial and municipal regulations, policies, practices and funding guidelines for arranging and paying the accommodations necessary for persons with disabilities to ensure an accessible democratic and electoral processes for all Ontarians during election campaign activities and

       The report on the review should be tabled in the Legislative Assembly no later than April 30, 2007. Filed on December 19, 2006.

41.  Mr. Prue – That, in the opinion of the House, the Democratic Renewal Secretariat (Elections Ontario) and Ministry of Municipal Affairs and Housing (Municipal Elections Act) should take immediate steps to establish an Elections Ontario Task Force and a Municipal Elections Task Force with the involvement of representatives of disabled communities, access and accommodations service providers, Elections Ontario and the Association of Municipal Clerks and Treasurers of Ontario, to develop and implement regulations, policies, practices and funding guidelines for arranging and paying the accommodations necessary for persons with disabilities to ensure an accessible democratic and electoral process for all Ontarians during election campaign activities, and;         

       The Task Force reports should be tabled in the Legislative Assembly no later than April 30, 2007. Filed on December 19, 2006.

43.  Mr. Tabuns – That, in the opinion of this House, the revenue collected by the Ontario Film Review Board for film and video classification be allocated toward a fund that assists Canadian distributors and filmmakers to market Canadian films. Filed on December 21, 2006.

44.  Mr. Hampton – That, in the opinion of this House, The Stamp Advisory Committee and Canada Post's Board of Directors should approve a commemorative stamp recognizing honourary Canadian citizen Raoul Wallenberg and the tens of thousands of Jews he saved during the Second World War. 45.  Ms. DiNovo – That, in the opinion of this House, the powers of the Ontario Municipal Board be amended so that they are not able to undermine the authority of democratically elected city councils in decisions such as land use planning and others. This would include restricting the ability of the OMB to overturn municipal planning decisions and increase the length of OMB appointee's terms to ensure non-partisan qualified appointments.
