The Chair (Mr. Deepak Anand): I’m going to start with Bill Pr20, An Act respecting Hot Docs. We have MPP Cho. MPP Cho, please introduce yourself and any comments on the bill.
Mr. Stan Cho: Thank you very much, Chair. I’m pleased to introduce this bill. I think Hot Docs is a wonderful organization, and if anybody is unfamiliar with the work they do and the services they provide, I encourage them to check them out.
Of course, like many industries, Hot Docs has been hit quite hard by this pandemic, but they were on the cutting edge of technology before COVID-19, using technology to reach a broader audience throughout Ontario.
I am proud to support this motion because this is an organization that has proven that they are adaptive. They have really laid the foundation for a big driver in our economy as we move forward. I’m hoping that this will have the support of the entire committee. I think it’s important to look to these organizations and how we can assist them, especially because the time will come soon when COVID-19 is behind us. I really hope that’s sooner than later, but it’s the time now to lay down that recovery foundation for success.
As I’ve said before, I think there will be a time when every jurisdiction will be competing for a competitive edge, and so the time to help organizations like Hot Docs is now. I will turn it back to you, Chair, with the sincere hope that every member on this committee will support this motion.
The Chair (Mr. Deepak Anand): Thank you so much. I see that we have Mr. Brett Hendrie, the executive director from Hot Docs. Mr. Hendrie, please introduce yourself and your comments.
Mr. Brett Hendrie: Thank you very much. Hello, everyone. My name is Brett Hendrie. I’m the executive director at Hot Docs. Thank you, MPP Cho, for those supportive remarks and thank you to this committee for the opportunity to speak to the Hot Docs tax relief bill.
I’ll just spend a quick minute or two to give folks some background on our organization. Hot Docs is a Toronto-based charity. Our flagship event, the annual Hot Docs Festival, is a true made-in-Ontario success story. The festival is now the largest event of its kind in North America and one of the largest film festivals anywhere, annually welcoming close to 250,000 attendees. The festival has become a major tourism draw, with nearly 20% of our audience coming from out of market, and also a major media event, with over 500 accredited journalists covering the festival from around the globe.
As we’ve grown the festival, we’ve also grown Hot Docs’s programs that generate support for the documentary film production sector, which is quite significant in Ontario. The Hot Docs Forum, our annual business-to-business market event, attracts to Toronto the world’s top funders for films, including representatives from Netflix, HBO, CNN, the BBC, PBS, ARTE and hundreds of others. These more than 400 international documentary buyers provide substantial foreign investment into Ontario’s production sector, and we’re proud of Hot Docs’s role in being a catalyst for the deals that happen at our events.
Year-round, we’re proud to operate the immensely popular Docs for Schools program, which brings free documentary programming and educational lesson plans to high schools all across Ontario. Last year, over 120,000 students and educators participated everywhere from Thunder Bay to Windsor to Kingston to Ottawa. The program has been celebrated for providing free programming to communities to help students build empathy and media literacy in an ever-complex and changing world.
Approximately eight years ago, Hot Docs opened what is now the Hot Docs Ted Rogers Cinema in downtown Toronto. The cinema has become a major success story, providing large audiences 365 days a year, receiving international attention for its innovative model of programming. Our year-round events, like the Hot Docs Podcast Festival and Curious Minds, have provided a major cultural anchor for the neighbourhood, in turn driving tourism and amplifying opportunities for local business and creating new revenue opportunities for local producers.
A recent third-party study found that Hot Docs has a regional economic impact of over $54 million a year, supporting over 650 jobs, many of those directly related to tourism, retail and other local businesses. The international TV, film and trade magazine Variety recently noted that the growth and reach of Hot Docs has been one of the most impressive cultural success stories from the past quarter century. We’re proud of these achievements that have supported Ontario’s cultural, tourism and retail sectors.
This bill would alleviate approximately $70,000 a year in expenses for the charity—critical savings which would allow Hot Docs to further invest in new programs and services that support the industry, expand programming and improve our ability to invest in strategies to attract out-of-market visitors. Hot Docs has discussed this bill with our local city councillor, Mike Layton, with Mayor Tory and his office and with councillors from all across the city of Toronto. They all overwhelmingly support this bill, and to that effect, Toronto city council officially passed a motion endorsing this plan and requesting this provincial legislation, as they understand Hot Docs’s important role in the cultural and economic development of the city.
As MPP Cho mentioned, Hot Docs has been significantly impacted by the COVID-19 pandemic. Both lockdowns have forced Hot Docs to close its cinema and cancel its physical festival. As a result of these challenges, Hot Docs successfully moved the majority of its programming online. In spite of these challenges, we are extremely well-positioned to thrive on the other side of the pandemic, as the vast majority of our audiences, filmmakers, industry and students we serve have maintained their participation with the organization through our virtual programs.
We opened the doors to our cinema eight years ago, the first-ever movie theatre dedicated to documentary films. Years later and with millions of patrons through the doors, the cinema’s success is clearly manifest and has become a model that is being mirrored internationally. We’re proud to help showcase Ontario and Toronto as a beacon for innovative cultural events and destinations. Passing this bill will allow Hot Docs to invest more in the marquee programs that draw out-of-market visitors and the industry support programs that support local producers and attract investment and sales to the Ontario marketplace. These efforts directly benefit not only filmmakers, but Ontario’s economy as a whole.
This legislation will also allow us to better serve Ontario’s diverse communities by offering more free programming to students, seniors, families, Indigenous organizations, newcomers and community partners. Committee members, it’s for these reasons that I request your support in passing the Hot Docs tax relief bill. Hot Docs looks forward to its continued work with the government of Ontario to help those in the industry flourish. Thank you.

I just want to speak in favour of this. My only question I had was answered during Mr. Hendrie’s deputation. It was about item number 6, that there was a concentrated effort on behalf of Hot Docs to work with the city of Toronto to exempt their property tax. I just wondered what the feedback was. He had mentioned that there was a motion endorsing that plan that they passed at city council. I know how difficult it is for the film industry and the theatre industry during COVID. I would echo MPP Cho’s comments and Mr. Hendrie’s comments as well. I just want to speak in favour of the bill. I think it’s an excellent idea.

This is definitely a challenging time, but I will underscore that the city council has been incredibly receptive and has endorsed this motion overwhelmingly at council. They’re a big believer in Hot Docs and our role in the economy and the cultural sector.

Mrs. Gila Martow: Hi. Obviously, I want to support this very, very much. I just have a couple of sentences to read from my sister Judy Gladstone, who was executive director at BravoFACT. I don’t know if Brett remembers when she was there. She says, “Hot Docs has grown. It’s North America’s most important documentary festival and the world’s second-most important documentary festival. They were one of the first important”—I’m not sure what she meant by that—“festivals that needed to pivot and present a virtual edition in the spring of 2020. They did a brilliant job. The festival traditionally draws hundreds of delegates from around the world to Toronto.”
So she was very excited to hear that we were discussing Hot Docs this morning, and of course, we want to support you in any way we can.
Mr. Brett Hendrie: Thank you, MPP Martow. That’s really appreciated. Judy Gladstone has been a tremendous participant at Hot Docs and understands, certainly, the economic benefits of attracting international buyers to Toronto, which she certainly supported as well, which is appreciated. Thank you.

Mr. Chris Glover: Actually, I do have a question for you, Clerk, but before I do that, I just want to also endorse this bill. I’m very supportive. I’m a big fan of Hot Docs. I live not too far away, and I’m a regular patron. I’ve got friends who are volunteers there, and I’ve got a lot of friends in the film industry who showcase their work there. It’s actually very important, the work that you’re doing, and I’m glad that we’re able to provide a little bit more support to your business, to the Hot Docs Festival.
My question to you, Clerk, is the same as Jennifer French’s: Am I officially subbed in? Am I allowed to vote for this, or am I just allowed to give moral support?

Mr. John Ashley: John Ashley. Good morning, committee Chair and committee members. I appear before you today to request special legislation to revive 1040062 Ontario Inc. The corporation was dissolved in error in the wrong year, being 2019. The articles of dissolution were to be certified in early 2020.
I received the letter of consent to dissolve the corporation from the Ministry of Finance in early 2019. I then called the Ministry of Government and Consumer Services to see how long it would take to have the articles of dissolution certified, and they told me six to eight weeks, but what they didn’t tell me was that the certified date is the day they receive it in the mail. I sent it out December 23, 2019, and the certified date was December 27, which is four days too early.
This revival is for tax purposes, for the distribution of final dividends to the shareholders of 1040062 Ontario Inc. in the year 2020.

I’m Chris Glover. I’m the MPP for Spadina–Fort York. It’s my pleasure to introduce Bill Pr33, An Act to revive 704176 Ontario Limited.
The Chair (Mr. Deepak Anand): Thank you so much, MPP Glover. Do we have Dara Azari, solicitor, on the call? Yes? Dara, can you please state your name and your comments about the bill—what are you trying to achieve through it? Thank you so much.
Mr. Dara Azari: Sure. My name is Dara Azari. I’m solicitor for the corporation. I’m here today on behalf of the applicant.
As a brief background, 704176 Ontario Ltd. was incorporated in 1987 to hold legal title to a rental property. The corporation was dissolved in 1995 for failure to comply with the Corporations Tax Act.
As a nominee, the corporation never had any income. The beneficial owners of the property have paid and continue to pay all property and income taxes with respect to the property. It’s my understanding that the corporation simply fell off the radar of the applicant due to its inactivity, and now the applicant needs to revive the corporation to sell the property.
That’s a brief background. I would be happy to answer any questions you have.
