EXPLANATORY NOTE

The Bill amends the Gift of Life Act.

Section 11 of the Act is amended to provide that a person who had given consent or with respect to whom consent had been given for their body to be used after the person’s death for transplants may be publicly identified as having been an organ or tissue donor if specified conditions are met.

An Act to amend the Gift of Life Act in order to recognize organ and tissue donors

His Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1 (1)  Subsection 11 (1) of the Gift of Life Act is amended by striking out “Except where legally required” at the beginning of the portion before clause (a) and substituting “Except in accordance with subsection (3) or where legally required”.

(2)  Section 11 of the Act is amended by adding the following subsection:

(3)  A deceased person who had given consent under subsection 4 (1) or with respect to whom consent had been given under subsection 5 (2) may be publicly identified as having been an organ or tissue donor if the following conditions are met:

   1.  The deceased person’s name is the only information used to identify the person, and no additional identifying information, including the date of the transplant, is made public.

   2.  The purpose of publicly identifying the deceased person as an organ or tissue donor is to recognize that fact in the form of a memorial or in any other form that the hospital considers appropriate to show appreciation for the deceased person.

   3.  At least six months have elapsed since the transplant to which the consent under subsection 4 (1) was given.

   4.  Consent to the deceased person being publicly identified as an organ or tissue donor, including the specific manner in which it will be done, has been obtained from,

           i.  if the deceased person gave the consent under subsection 4 (1), the person who would be the deceased person’s substitute under subsection 5 (2) at the time at which the consent to the public identification is given, or

          ii.  if the deceased person’s substitute gave the consent under subsection 5 (2), the substitute who gave that consent.

Commencement

2 This Act comes into force on the day it receives Royal Assent.

Short title

3 The short title of this Act is the Robbie’s Legacy Act (Honouring Beloved Organ and Tissue Donors), 2024.
