An Act to amend the City of Ottawa Act, 1999

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  Section 12 of the City of Ottawa Act, 1999 is repealed and the following substituted:

Board of Health established

   12.  (1)  The Board of Health for the City of Ottawa Health Unit is established as a board of health for the city and is deemed to be a board of health established under the Health Protection and Promotion Act.

Size and composition

   (2)  The board of health shall be composed of 11 members, consisting of,

  (a)  six members of the city council; and

  (b)  five citizen representatives.

Appointment by city council

   (3)  Despite subsections 49 (1) and (3) of the Health Protection and Promotion Act,

  (a)  the members of the board of health who are members of the city council shall be appointed by the city council; and

  (b)  the members of the board of health who are citizen representatives shall be appointed,

           (i)  in the case of the first term of appointment, by the city council, and

          (ii)  in the case of subsequent terms of appointment, by the board of health.

Area of jurisdiction

   (4)  The area of jurisdiction for the board of health is the city.

Functions of board

   (5)  The board of health shall,

  (a)  make recommendations to the city council on any issues within the city council's jurisdiction that involve public health considerations; and

  (b)  report annually to the city council on the operations of the board of health.

Duty of city

   (6)  Despite the Health Protection and Promotion Act, the city has the duty of providing to the board of health public health employees, who shall remain employees of the city.

Commencement

   2.  This Act comes into force three months after the day it receives Royal Assent.

Short title

   3.  The short title of this Act is the City of Ottawa Amendment Act, 2009.

 

EXPLANATORY NOTE

The Bill amends the City of Ottawa Act, 1999 to establish an independent board of health for the City of Ottawa under the Health Protection and Promotion Act.  The Bill sets out the size and composition of the board of health and rules for the appointment of board members.  The board of health is required to make recommendations to the city council on any issues within the city council's jurisdiction that involve public health considerations.
