An Act to require the introduction of legislation to resolve the strike at York University by December 11, 2008

Preamble

York University and Canadian Union of Public Employees, Local 3903 have reached an impasse in bargaining and a strike is underway at the University.  This disruption is hurting the education of a great many students.  This disruption must be resolved without further lost instructional time.  To achieve this, a legislated settlement of the dispute must be imposed.

Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

Legislation

   1.  (1)  The Minister of Labour shall introduce a bill to resolve the strike by the employees of York University who are represented by Canadian Union of Public Employees, Local 3903.

Minister's efforts

   (2)  The Minister of Labour shall make all reasonable efforts to ensure that the bill is passed.

Terms

   (3)  The bill shall specify the terms of a new contract between York University and Canadian Union of Public Employees, Local 3903.

Length of contract

   (4)  The new contract shall be for a term of three years.

Deemed collective agreement

   (5)  The new contract shall be deemed to be the new collective agreement between York University and Canadian Union of Public Employees, Local 3903.

Application

   (6)  Subsections (1) to (5) do not apply if the strike is resolved on or before December 11, 2008.

Commencement

   2.  This Act comes into force on the day it receives Royal Assent.

Short title

   3.  The short title of this Act is the Back to Work Act (York University), 2008.

 

 

EXPLANATORY NOTE

The Bill requires the Minister of Labour to introduce legislation no later than December 11, 2008 to resolve the strike by the employees of York University who are represented by Canadian Union of Public Employees, Local 3903 if the strike is not resolved by that date.  The Bill requires the Minister of Labour to make all reasonable efforts to ensure the legislation is passed.  The legislation must specify the terms of a new contract between the University and the Union.  The new contract must be for a term of three years.
