An Act to amend the Education Act with respect to fundraising

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
1. Subsection 170 (3) of the Education Act is repealed.
2. The Act is amended by adding the following section:
School councils
Fundraising
170.0.1 (1) Subject to subsection (2), a school council may engage in fundraising activities.

(2) A school council shall not engage in fundraising activities unless,
(a) the activities are conducted in accordance with any applicable policies established by the board; and
(b) the activities are to raise funds for a purpose approved by the board or authorized by any applicable policies established by the board.
Use of funds
(3) A school council shall ensure that any funds raised by it or by any other person or entity,
(a) are not used for expenditures on the operating costs of a school or on capital undertakings of a school; and
(b) are used in accordance with any applicable policies established by the board.

(4) For the purpose of clause (3) (a), expenditures on the operating costs of a school or on capital undertakings of a school include expenditures relating to,
(a) providing instruction to pupils;
(b) transporting pupils to and from school;
(c) the administration and maintenance of the school; and
(d) pupil accommodation.
Regulations
(5) The Lieutenant Governor in Council may make regulations respecting school councils, including regulations relating to their establishment, composition and functions.
Commencement
3. This Act comes into force on the day it receives Royal Assent.
Short title
4. The short title of this Act is the No More Financing Tiers in Education Act, 2007.
EXPLANATORY NOTE
The Bill adds a section to the Education Act respecting fundraising by school councils. The section provides that school councils may raise funds in accordance with applicable policies established by the board and for purposes approved by the board or authorized by board policies. A school council shall ensure that any funds raised by it or by any other person or entity are not used for expenditures on the operating costs or capital undertakings of a school.
