An Act to amend the
Developmental Services Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
1. The definition of "facility" in section 1 of the Developmental Services Act is repealed and the following substituted:
"facility" means a facility set out in the Table to subsection 2 (1); ("établissement")
2. Subsection 2 (1) of the Act is repealed and the following substituted:

(1) The Minister shall operate and maintain the facilities set out in the following Table under the names set out in the Table:

French names
(1.1) The Minister may operate and maintain a facility under a French equivalent of its name set out in the Table to subsection (1) in addition to that name.
Services and assistance
(1.2) The Minister shall ensure that residents of facilities receive the services and assistance that are necessary for their needs.
3. Clause 36 (a) of the Act is repealed and the following substituted:
(a) limiting, restricting or exempting a facility or class of facility from the application of any part of the regulations;
Commencement
4. This Act comes into force on the day it receives Royal Assent.
Short title
5. The short title of this Act is the Developmental Services Amendment Act, 2005.
EXPLANATORY NOTE
The Bill amends the Developmental Services Act to require the Minister under the Act to operate and maintain the present facilities for persons with a developmental disability under the following names: Huronia Regional Centre of Excellence at Orillia, Rideau Regional Centre of Excellence at Smiths Falls, and Southwestern Regional Centre of Excellence at Cedar Springs. The Bill prevents the Minister from establishing any further facilities.
Under the Bill, the Minister has to ensure that residents of facilities receive the services and assistance that are necessary for their needs.
