An Act to amend the
Greenbelt Act, 2005 by
establishing the Niagara Greenbelt
Advisory Committee and the
Holland Marsh Greenbelt
Advisory Committee
Note: This Act amends the Greenbelt Act, 2005 which has not previously been amended.
Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
1. Subsection 1 (1) of the Greenbelt Act, 2005 is amended by adding the following definitions:
"Holland Marsh Area" means the area of Holland Marsh or the area that the Lieutenant Governor in Council designates as the Holland Marsh Area by regulation under subsection 2 (1); ("zone du marais Holland")
"Niagara Area" means the territory of The Regional Municipality of Niagara or the area that the Lieutenant Governor in Council designates as the Niagara Area by regulation under subsection 2 (1); ("zone du Niagara")
2. Clause 2 (1) (a) of the Act is repealed and the following substituted:
(a) designate an area of land as the Greenbelt Area, the Niagara Area or the Holland Marsh Area; and
3. Clause 10 (2) (a) of the Act is repealed and the following substituted:
(a) consult with any affected public bodies, including the Ministry of Natural Resources, the Niagara Escarpment Commission, the Greenbelt Council established under section 15 and all advisory committees established under section 15.1;
4. Clause 11 (4) (a) of the Act is repealed and the following substituted:
(a) consult with any affected public bodies, including the Ministry of Natural Resources, the Niagara Escarpment Commission, the Greenbelt Council established under section 15 and all advisory committees established under section 15.1;
5. Section 15 of the Act is amended by adding the following subsection:
Restriction
(2.1) At the time of appointing members, the Minister shall ensure that at least one-half of the members of the Council come from the agriculture sector.
6. The Act is amended by adding the following section:
Advisory Committees
15.1 (1) The following advisory committees are established:
1. A committee to be known in English as the Niagara Greenbelt Advisory Committee and in French as Comité consultatif de la ceinture de verdure du Niagara.
2. A committee to be known in English as the Holland Marsh Greenbelt Advisory Committee and in French as Comité consultatif de la ceinture de verdure du marais Holland.
Members
(2) Each advisory committee shall consist of the members, being one or more persons, whom the Lieutenant Governor in Council appoints at pleasure.
Restriction
(3) At the time of appointing members, the Lieutenant Governor in Council shall ensure that at least one-half of the members of each advisory committee come from the agriculture sector and shall refer the appointments to a standing committee of the Assembly that is empowered to review and report to the Assembly its observations, opinions and recommendations on the operation of the advisory committee.
Functions
(4) The Minister shall fix the terms of reference of each advisory committee.
Other functions
(5) Subject to subsection (4), the Niagara Greenbelt Advisory Committee shall advise the Minister on matters relating to this Act in the Niagara Area, including the unique nature of tender fruit areas.

(6) Subject to subsection (4), the Holland Marsh Greenbelt Advisory Committee shall advise the Minister on matters relating to this Act in the Holland Marsh Area, including specialty crops.
7. Subsection 22 (1) of the Act is amended by adding the following clause:
(e) define agriculture sector for the purpose of subsection 15 (2.1) or 15.1 (3).
Commencement
8. This Act comes into force on the day it receives Royal Assent.
Short title
9. The short title of this Act is the Greenbelt Amendment Act, 2005.
EXPLANATORY NOTE
The Bill amends the Greenbelt Act, 2005 to establish two advisory committees, the Niagara Greenbelt Advisory Committee and the Holland Marsh Greenbelt Advisory Committee.
The Lieutenant Governor in Council appoints the members of each committee, at least half of whom must come from the agriculture sector. The Minister of Municipal Affairs and Housing fixes the terms of reference of each committee. In addition, the Niagara Greenbelt Advisory Committee is required to advise the Minister on matters relating to the Act in the area of Niagara, including the unique nature of tender fruit areas. The Holland Marsh Greenbelt Advisory Committee is required to advise the Minister on matters relating to the Act in the area of Holland Marsh, including specialty crops.
The Bill also amends the Act so that at least half of the members of the Greenbelt Council come from the agriculture sector.
