An Act to amend the
Employment Standards Act, 2000
with respect to public holidays
for certain workers
Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
1. Part X of the Employment Standards Act, 2000 is amended by adding the following section:
Entitlement despite agreement
32.1 Despite any exemption made under the regulations, this Part applies to a person even if the person is employed under an agreement whereby he or she may elect to work or not when requested to do so.
Commencement
2. This Act comes into force on the day it receives Royal Assent.
Short title
3. The short title of this Act is the Employment Standards Amendment Act, 2003.

EXPLANATORY NOTE
The Employment Standards Act, 2000 is amended to guarantee that workers who have entered into agreements providing that they may elect to work or not when requested to do so are entitled to the benefits of the public holidays part of the Act.
