An Act to amend the
Tenant Protection Act, 1997

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. Section 138 of the Tenant Protection Act, 1997 is amended by adding the following subsection:

Exception

(1.1) Despite paragraph 1 of subsection (1), a landlord may not apply to the Tribunal for an order referred to in subsection (1) in the case of an extraordinary increase in the cost of hydro between May 1, 2002 and December 1, 2002.

Commencement

2. This Act comes into force on the day it receives Royal Assent.

Short title

3. The short title of this Act is the Tenant Protection Amendment Act (Hydro Exception), 2002.

EXPLANATORY NOTE

The Act is amended so that landlords may not request a rent increase greater than the guideline on account of an extraordinary increase in the cost of hydro between May 1, 2002 and December 1, 2002.
