An Act to amend the
Child and Family Services Act
to allow one Children's Aid Society
access to information held by
another Children's Aid Society
Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
1. The Child and Family Services Act is amended by adding the following section:
Access by one society to information
held by another society
182.1 (1) For the purpose of carrying its functions under this Act, a society shall have access to information held by another society unless,
(a) the information is protected by solicitor-client privilege;
(b) the information may not be disclosed under the Young Offenders Act (Canada) or under section 35 of the Mental Health Act; or
(c) the information is subject to an order of a court.
Override
(2) This section applies despite any other provision in this Part.
Commencement
2. This Act comes into force on the day it receives Royal Assent.
Short title
3. The short title of this Act is the Child and Family Services Amendment Act, 2002.

EXPLANATORY NOTE
The Bill amends the Child and Family Services Act to allow one Children's Aid Society access to information held by another Children's Aid Society subject to limited exceptions.
