Government Process Simplification Act

EXPLANATORY NOTE

The Bill amends five statutes that are administered by the Ministry of the Solicitor General and the Ministry of Correctional Services. The general purpose of the amendments is to simplify government processes and improve efficiency.

Anatomy Act

A court form that is set out in the Act is repealed and, in future, is to be prescribed by the Minister by regulation. Other forms may be specified by the Minister without a regulation.

Coroners Act

Two forms (a summons to a witness before an inquest and a bench warrant) that are set out in the Act are repealed and, in future, are to be prescribed by the Minister by regulation. The power to make regulations prescribing fees and allowances payable to persons who provide services to coroners and the power to make regulations prescribing forms are transferred from the Lieutenant Governor in Council to the Minister. The Minister is authorized to set the fees and allowances payable to coroners without a regulation.

Ministry of Correctional Services Act

The need for a warrant to transfer inmates from one correctional institution to another is eliminated. The power to prescribe by regulation the form of a warrant to arrest a parolee who has broken his or her parole conditions is transferred from the Lieutenant Governor in Council to the Minister. The Minister is given the power to require fees and forms (other than the warrant) without a regulation.

Ontario Society for the Prevention of Cruelty to Animals Act

Two court forms set out in the Act are repealed and, in future, are to be prescribed by the Minister by regulation.

Private Investigators and Security Guards Act

The powers and duties that are assigned to the Commissioner of the Ontario Provincial Police in the current Act are transferred to the deputy minister of the Ministry, or his or her delegate.

Private investigator and security guard licences (including renewals and temporary licences) are made to expire on the day set out in the licence rather than having all licences expire each year on March 31.

The Minister may, without a regulation, specify the uniforms, badges, shields and insignia to be used by security guards and the identification cards to be used by security guards and private investigators and may charge fees and require forms.

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

Anatomy Act

1. Section 6 of the Anatomy Act is amended by striking out "(Form to this Act)" in the fifth line and by adding "in the prescribed form" at the end.

2. (1) Clause 14 (e) of the Act is repealed.

(2) Section 14 of the Act is amended by adding the following subsections:

(2) The Minister responsible for the administration of this Act may by regulation prescribe the form of the order that may be made under section 6.

Forms

(3) Subject to subsection (2), the Minister responsible for the administration of this Act may require that forms approved by the Minister be used for any purpose of this Act.

3. The Form to the Act is repealed.

Coroners Act

4. (1) Subsection 40 (2) of the Coroners Act is amended by striking out "in Form 1" in the second line and substituting "in the prescribed form".

(2) Subsection 40 (3) of the Act is amended by striking out "in Form 2" in the eleventh line and substituting "in the prescribed form".

5. (1) Clauses 56 (b), (c) and (g) of the Act are repealed.

(2) Section 56 of the Act is amended by adding the following subsections:

(2) The Minister may make regulations,

(a) prescribing forms and providing for their use;

(b) prescribing fees and allowances that shall be paid to persons rendering services in connection with coroners' investigations and inquests and providing for the adjustment of such fees and allowances in special circumstances.

Coroners' fees and allowances

(3) The Minister may set fees and allowances for coroners for services performed under this or any other Act and may provide for the adjustment of such fees and allowances in special circumstances.

6. Forms 1 and 2 of the Act are repealed.

Ministry of Correctional Services Act

7. Section 18 of the Ministry of Correctional Services Act is amended by striking out "by warrant" in the fourth and fifth lines.

8. Subsection 19 (2) of the Act is repealed.

9. Section 38 of the Act is amended by striking out "in the form prescribed by the regulations" at the end.

10. (1) Clauses 60 (s) and (t) of the Act are repealed.

(2) Section 60 of the Act is amended by adding the following subsections:

(2) The Minister may by regulation prescribe the form of the warrant for the purpose of section 39.

Forms

(3) Subject to subsection (2), the Minister may require that forms approved by the Minister be used for any purpose of this Act.

Fees and charges

(4) The Minister may impose and collect fees and charges to recover costs incurred by the Ministry.

Ontario Society for the Prevention of Cruelty to Animals Act

11. (1) Subsection 12 (1) of the Ontario Society for the Prevention of Cruelty to Animals Act is amended by striking out "in Form 1" in the second line and "in Form 2" in the seventh line.

(2) Section 12 of the Act is amended by adding the following subsection:

(6) The Minister responsible for the administration of this Act may make regulations prescribing the form for the information on oath required by subsection (1) and for the warrant issued under subsection (1).

12. Forms 1 and 2 of the Act are repealed.

Private Investigators and Security Guards Act

13. (1) The definition of "Commissioner" in section 1 of the Private Investigators and Security Guards Act is repealed.

(2) Section 1 of the Act is amended by adding the following definition:

"deputy minister" means the deputy minister to the Minister who is responsible for the administration of this Act. ("sous-ministre")

14. Subsection 3 (1) of the Act is amended by striking out "the Commissioner" in the seventh and eighth lines and substituting "the deputy minister".

15. Subsection 5 (1) of the Act is amended by striking out "upon the prescribed form which shall be accompanied by the prescribed fees" in the seventh, eighth and ninth lines and substituting "and the application shall be accompanied by the required fees".

16. Subsection 9 (3) of the Act is repealed.

17. Section 11 of the Act is repealed and the following substituted:

Expiry of licences

11. Every licence and renewal of licence expires on the day set out in the licence or renewal.

18. Section 18 of the Act is repealed and the following substituted:

Information confidential

18. Any information received by the Registrar, or by an employee of the Ministry whose Minister is responsible for the administration of this Act, in connection with an application or a record or return required under this Act or in the course of an inquiry or investigation authorized by this Act shall not be disclosed without the consent of the deputy minister.

19. (1) Subsection 20 (1) of the Act is amended by striking out "the Commissioner" in the last line and substituting "the deputy minister".

(2) Subsection 20 (2) of the Act is amended by striking out "the Commissioner" in the second line and substituting "the deputy minister".

(3) Subsection 20 (3) of the Act is amended by striking out "the Commissioner" in the first line and in the eighth line and substituting in each case "the deputy minister".

(4) Subsection 20 (4) of the Act is amended by striking out "the Commissioner" in the first line and substituting "the deputy minister".

(5) Subsection 20 (5) of the Act is amended by striking out "the Commissioner" in the first line, in the fourth and fifth lines and in the sixth line and substituting in each case "the deputy minister".

(6) Subsection 20 (6) of the Act is amended by striking out "the Commissioner" in the first and second lines and substituting "the deputy minister".

(7) Subsection 20 (7) of the Act is amended by striking out "the Commissioner" in the second line and substituting "the deputy minister".

20. (1) Subsection 21 (1) of the Act is amended by striking out "the Commissioner" in the first line and substituting "the deputy minister".

(2) Subsection 21 (2) of the Act is amended by striking out "the Commissioner" in the second line and substituting "the deputy minister".

(3) Subsection 21 (3) of the Act is amended by striking out "The Commissioner" in the first line and substituting "The deputy minister".

(4) Subsection 21 (5) of the Act is amended by striking out "the Commissioner" in the last line and substituting "the deputy minister".

21. (1) Clause 25 (1) (a) of the Act is amended by striking out "prescribed".

(2) Subsection 25 (2) of the Act is amended by striking out "prescribed" in the second line.

22. (1) Subsection 28 (1) of the Act is amended by strikingout "prescribed" in the second line.

(2) Subsection 28 (2) of the Act is amended by striking out "prescribed" in the third line.

23. Subsection 32 (4) of the Act is amended by striking out "the Commissioner" in the fourth and fifth lines and substituting "the deputy minister".

24. (1) Clause 33 (c) of the Act is amended by striking out "the Commissioner" in the last line and substituting "the deputy minister".

(2) Section 33 of the Act is amended by striking out "the Commissioner" in the fourteenth and fifteenth lines and in the sixteenth line and substituting in each case "the deputy minister".

25. The Act is amended by adding the following section:

Delegation

33.1 The deputy minister may delegate in writing any of his or her powers or duties under sections 3, 18, 20, 21, 32 and 33 or under a regulation to an employee of the Ministry whose Minister is responsible for the administration of this Act, subject to such limitations, restrictions, conditions and requirements as may be set out in the delegation.

26. (1) Clauses 34 (b), (c), (f) and (h) of the Act are repealed.

(2) Section 34 of the Act is amended by adding the following subsection:

Powers of Minister

(2) The Minister responsible for the administration of this Act may,

(a) specify the uniforms, badges, shields and insignia to be worn or used by security guards;

(b) determine the form and contents of identification cards issued to licensees and the procedures respecting their issuance;

(c) require that forms approved by the Minister be used for any purpose of this Act; and

(d) establish and charge fees for the issuance or renewal of a licence.

General

Commencement

27. This Act comes into force on a day to be named by proclamation of the Lieutenant Governor.

Short title

28. The short title of this Act is the Government Process Simplification Act (Ministries of the Solicitor General and Correctional Services), 1996.
