Government Process Simplification Act

(Ministry of Northern Development and Mines), 1996

EXPLANATORY NOTE

The Bill amends or repeals statutes administered by the Ministry of Northern Development and Mines to improve administrative efficiency in that Ministry.

1. The repeal of Part X of the Mining Act removes the requirement for refineries processing gold, silver, platinum and other precious metals to hold a refinery licence. The administrative burden associated with the issuing and renewing of licences, and the issuing of certificates of exemption, is eliminated.

2. Subsection 1 (5) of the Bill (new section 180.1 of the Mining Act) vests the Crown's interest in the mining rights relating to certain lands formerly owned by the Canada Company in the owners of the surface rights of those lands. This change eliminates the need to examine applications from surface rights owners requesting that the Crown grant the mining rights to them. The "Canada Company's Lands" statutes that authorized the Crown to grant the mining rights to the surface rights owners are repealed in consequence.

Efficiency in the Ministry of Northern Development and Mines

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. (1) Part X of the Mining Act is repealed.

(2) Clause 164 (1) (h) of the Act, as amended by the Statutes of Ontario, 1996, chapter 1, Schedule O, section 29, is further amended by striking out "or Part X" in the second line.

(3) Subsection 169 (1) of the Act is amended by striking out "or Part X" in the second and third lines.

(4) Subsection 169 (2) of the Act is amended by striking out "or Part X" at the end.

(5) The Act is amended by adding the following section:

VESTING OF MINING RIGHTS: FORMER CANADA COMPANY LANDS

Vesting of Crown interest in mining rights in surface rights owners

180.1 Any interest of the Crown in the mining rights relating to the lands described in the indentures recited in The Canada Company's Lands Act, 1922 is vested in the registered owners of the surface rights of those lands, subject to all registered encumbrances against the surface rights.

2. The following are repealed:

1. The Canada Company's Lands Act, 1922.

2. The Canada Company's Lands Act, 1923.

3. The Canada Company's Lands Amendment Act, 1953.

4. Section 23 of The Metric Conversion Statute Law Amendment Act, 1978.

Commencement

3. This Act comes into force on the day it receives Royal Assent.

Short title

4. The short title of this Act is the Government Process Simplification Act (Ministry of Northern Development and Mines), 1996.
