Red Tape Reduction Act

EXPLANATORY NOTE
The Bill is part of the government's initiative to reduce red tape.
Section 1 of the Bill would authorize the Ontario Energy Board to approve or fix rates based on a methodology other than the methodology set out in subsections 19 (2) to (6) of the Ontario Energy Board Act.
Section 2 of the Bill would repeal the Ontario Energy Corporation Act and dissolve the Ontario Energy Corporation.

An Act to reduce red tape by amending
the Ontario Energy Board Act and
repealing the Ontario Energy Corporation Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
Ontario Energy Board Act
1. Section 19 of the Ontario Energy Board Act is amended by adding the following subsection:
Alternative methodology
(7.1) Subsections (2) to (6) do not apply if the Board is of the opinion that an alternative methodology should be used for approving or fixing just and reasonable rates and other charges.
Ontario Energy Corporation Act
2. (1) The Ontario Energy Corporation Act is repealed.
(2) The assets and liabilities of the Ontario Energy Corporation are transferred to and assumed by Her Majesty in right of Ontario, as represented by the Minister of Environment and Energy.
(3) The Ontario Energy Corporation is dissolved.

Commencement
3. (1) Subject to subsection (2), this Act comes into force on the day it receives Royal Assent.

(2) Section 2 comes into force on a day to be named by proclamation of the Lieutenant Governor.
Short title
4. The short title of this Act is the Red Tape Reduction Act (Ministry of Environment and Energy), 1997.
