EXPLANATORY NOTE
This Explanatory Note was written as a reader’s aid to Bill 265 and does not form part of the law.
Bill 265 has been enacted as Chapter 10 of the Statutes of Ontario, 2021.
Section 7 of the Executive Council Act sets out attendance requirements of government ministers during Question Periods in the Legislative Assembly, along with related reporting obligations and penalties for non-compliance. The Bill amends section 7 to provide that it does not apply with respect to the 42nd Legislature. In addition, absences arising from declared emergencies or orders under the Emergency Management and Civil Protection Act are added to the list of permissible absences in subsection 7 (2) of the Act.

An Act to amend the Executive Council Act in respect of attendance at Question Period
Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
1 (1) Subsection 7 (2) of the Executive Council Act is amended by striking out “or” at the end of clause (a), by adding “or” at the end of clause (b) and by adding the following clause:
(c) a measure, requirement or action taken or implemented as a result of a declared emergency or order under the Emergency Management and Civil Protection Act, including any measure or action taken or order made in relation to the emergency after the declaration is no longer in effect.
(2) Section 7 of the Act is amended by adding the following subsection:
Non-application during 42nd Legislature
(7) This section does not apply with respect to the 42nd Legislature.
Commencement
2 This Act comes into force on the day it receives Royal Assent.
Short title
3 The short title of this Act is the Executive Council Amendment Act, 2021.
