An Act to amend the Public Hospitals Act with respect to board membership

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
1. The Public Hospitals Act is amended by adding the following section:
Members prohibited
12.1 (1) Despite any other Act, no person is entitled to be a member of the board of directors or appointed as a life, term or honorary director if he or she is a current member of,
(a) a council of a municipality;
(b) the Legislative Assembly; or
(c) the House of Commons of Canada.
Membership on board ceases
(2) If, on the day this section comes into force, a person is a member of the board of directors or appointed as a life, term or honorary director in contravention of subsection (1), that person ceases to be a member of the board of directors or a director.
Commencement
2. This Act comes into force on the day it receives Royal Assent.
Short title
3. The short title of this Act is the Strengthening Public Hospitals Act, 2010.
EXPLANATORY NOTE
The Bill amends the Public Hospitals Act to prohibit members of a council of a municipality, the Legislative Assembly or the House of Commons of Canada from being members of the board of directors or from being appointed as a life, term or honorary director of a public hospital.
