An Act to amend the Building Code Act, 1992 with respect to storm water harvesting

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
1. Section 8 of the Building Code Act, 1992 is amended by adding the following subsections:
Storm water harvesting
(2.0.1) The chief building official shall refuse to issue a permit to construct a building if the proposed building,
(a) includes or is served by a storage garage; and
(b) does not include a storm water harvesting system prescribed by regulation.

(2.0.2) Subsection (2.0.1) applies if the application for a permit to construct a building is made on or after January 1, 2010.
Definitions
(2.0.3) For the purpose of subsection (2.0.1),
"storage garage" means a building or part of a building that is intended for the storage or parking of motor vehicles and that contains no provision for the repair or servicing of motor vehicles; ("garage de remisage")
"storm water" means rainwater runoff, water runoff from roofs, snowmelt and surface runoff. ("eaux pluviales")
2. Subsection 34 (1) of the Act is amended by adding the following paragraph:
3.3.1 prescribing storm water harvesting systems for the purposes of clause 8 (2.0.1) (b);
Commencement
3. This Act comes into force on the day it receives Royal Assent.
Short title
4. The short title of this Act is the Building Code Amendment Act (Storm Water Harvesting), 2008.
EXPLANATORY NOTE
The Bill amends the Building Code Act, 1992 to prohibit the chief building official from issuing a permit to construct a building if the proposed building includes or is served by a storage garage and does not include a storm water harvesting system. The prohibition applies to permit applications made on or after January 1, 2010.
