An Act to amend the Regulated Health Professions Act, 1991

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
1. Section 76 of Schedule 2 to the Regulated Health Professions Act, 1991 is amended by adding the following subsections:
Reasonable inquiries
(1.1) An investigator may make reasonable inquiries of any person, including the member who is the subject of the investigation, on matters relevant to the investigation.

Member to co-operate
(3.1) A member shall co-operate fully with an investigator.
2. Subsection 95 (1) of Schedule 2 to the Act is amended by adding the following clause:
(h.1) providing for the direct observation of a member in his or her practice, including the direct observation by inspectors of procedures, during the course of an inspection or examination provided for under clause (h);

3. This Act comes into force on the day it receives Royal Assent.
Short title
4. The short title of this Act is the Regulated Health Professions Amendment Act, 2009.
EXPLANATORY NOTE
This Explanatory Note was written as a reader's aid to Bill 141 and does not form part of the law. Bill 141 has been enacted as Chapter 6 of the Statutes of Ontario, 2009.
The Health Professions Procedural Code of the Regulated Health Professions Act, 1991 is amended,
(a) to permit investigators acting under section 76 of the Code to make reasonable inquiries of any person, including the member who is the subject of the investigation, and requiring a member of a health college to co-operate fully with an investigator;
(b) to permit health colleges to make regulations providing for the direct observation of members in their practices.
