An Act to amend the
Members' Integrity Act, 1994
Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
1. The Members' Integrity Act, 1994 is amended by adding the following section:
Purpose
0.1 The purpose of this Act is to impose obligations on members of the Assembly in the performance of their duties of office, with a view to promoting public confidence in their integrity.
2. Section 16 of the Act is amended by adding the following subsection:
Request for Commissioner's opinion
(2) A member of the Executive Council who has any grounds whatsoever to believe that the member has a conflict of interest in a matter requiring the member's decision shall request that the Commissioner give an opinion and recommendations to the member as part of determining, for the purpose of subsection (1), whether the grounds are reasonable.
Commencement
3. This Act comes into force on the day it receives Royal Assent.
Short title
4. The short title of this Act is the Members' Integrity Amendment Act, 2004.

EXPLANATORY NOTE
The Bill amends the Members' Integrity Act, 1994. At present, a member of the Executive Council who has reasonable grounds to believe that the member has a conflict of interest in a matter requiring the member's decision is required to request that another member of the Council be appointed to perform the member's duties in the matter. The Bill requires that a member of the Council who has any grounds whatsoever to believe that the member has a conflict of interest in a matter requiring the member's decision request that the Commissioner give an opinion and recommendations to the member, as part of determining whether the grounds are reasonable.
