An Act to amend the
Assessment Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
1. Section 7 of the Assessment Act, as re-enacted by the Statutes of Ontario, 1997, chapter 5, section 5 and amended by 1997, chapter 29, section 4 and 2002, chapter 22, section 3, is amended by adding the following subsection:
Exception
(4) Despite subsection (3) and despite any other legislative or regulatory provision or any decision to the contrary, property and buildings used in transforming maple sap into pure maple syrup and pure maple products shall be deemed to be included in the farm property class, including property and buildings used in the evaporation and packaging processes if those processes are carried out on the same property where the maple sap is transformed.
Commencement
2. This Act comes into force on the day it receives Royal Assent.
Short title
3. The short title of this Act is the Assessment Amendment Act (Maple Syrup), 2004.

EXPLANATORY NOTE
The purpose of the Bill is to ensure that property and buildings used in the transforming of maple sap into pure maple syrup and pure maple products belong to the farm property class, including property and buildings used in the evaporation and packaging processes if those processes take place on the same property where the maple sap is transformed.
