An Act to amend
the Public Sector Salary
Disclosure Act, 1996
Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
1. Section 1 of the Public Sector Salary Disclosure Act, 1996 is repealed and the following substituted:
Purpose
1. The purpose of this Act is to require the public disclosure of the salary and benefits paid in respect of employment in the public sector,
(a) to employees who are appointed to hold office by the Lieutenant Governor in Council or by a member of the Executive Council; and
(b) to employees, other than employees described in clause (a), who are paid a salary of at least $100,000 in a year.
2. (1) Subsection 3 (1) of the Act is repealed and the following substituted:
Public disclosure
(1) Not later than March 31 of each year, commencing with the year 2002, every employer shall make available for inspection by the public without charge a written record of the amount of salary and benefits paid in the previous year by the employer to or in respect of,
(a) every employee who was appointed to hold office by the Lieutenant Governor in Council or by a member of the Executive Council; and
(b) every employee, other than an employee described in clause (a), who is paid at least $100,000 in salary.
(2) Subsection 3 (3) of the Act is repealed and the following substituted:
Statement when record not required
(3) If an employer has no employees for a year in respect of whom a written record is required to be available under subsection (1), the employer shall make available for inspection by the public, without charge and no later than March 31 of the following year, a written statement certified by the highest ranking officer of the employer,
(a) that the employer paid no employee a salary of $100,000 or more for the year; and
(b) that the employer did not have any employees described in clause (1) (a) at any time in the year.
Commencement
3. This Act comes into force on the day it receives Royal Assent.
Short title
4. The short title of this Act is the Public Sector Salary Disclosure Amendment Act (Friends on the Take), 2001.
EXPLANATORY NOTE
The purpose of the Bill is to amend the Public Sector Salary Disclosure Act, 1996 to require the public disclosure of all salaries and benefits paid in 2001 and later years to persons appointed to hold public office by the Lieutenant Governor in Council or by a Minister of the Crown.
