An Act to amend the Fire Protection
and Prevention Act, 1997

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. The Fire Protection and Prevention Act, 1997 is amended by adding the following section:

Proposed reduction or restructuring

10.1 (1) A fire chief shall submit to the Fire Marshal any proposal to reduce or restructure fire protection services.

If no fire department

(2) If a municipality does not have a fire department, the clerk of the municipality shall submit to the Fire Marshal any proposal to reduce or restructure fire protection services.

Review by Fire Marshal

(3) The Fire Marshal shall review each proposal and either approve it or reject it.

Reasons

(4) The Fire Marshal shall give reasons for rejecting any proposal.

Approval required

(5) A proposal shall not be implemented unless it has been approved by the Fire Marshal.

Annual report

(6) Within 30 days after the end of each calendar year, the Fire Marshal shall submit a report to the Minister on the proposals reviewed and approved or rejected by the Fire Marshal.

2. Subsection 78 (1) of the Act is amended by adding the following clause:

(d.1) defining "reduce or restructure fire protection services" for the purposes of section 10.1;

Commencement

3. This Act comes into force on a day to be named by proclamation of the Lieutenant Governor.

Short title

4. The short title of this Act is the Fire Protection and Prevention Amendment Act, 2001.

EXPLANATORY NOTE

The purpose of the Bill is to require that any proposals to reduce or restructure fire protection services be approved by the Fire Marshal before being implemented. The Fire Marshal would be required to report annually to the Minister on the proposals reviewed.
