An Act to amend
the Electricity Act, 1998
to ensure that the transmission corridors
remain provincial assets to be used
for public transit, recreational
and similar purposes

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

1. Section 48 of the Electricity Act, 1998 is amended by adding the following subsections:

Transmission corridor lands excepted

(4) The hydro transmission corridor lands held by Ontario Hydro,

(a) on the day before the Ontario Electric Services Corporation was incorporated, shall be deemed not to have been included in the assets of the Services Corporation; and

(b) as of the day the Services Corporation was incorporated, shall be deemed to have been transferred to and be assets of Her Majesty in right of Ontario.

Transfer at no costs

(5) The deemed transfer of the hydro transmission corridor lands shall be at no cost to Her Majesty in right of Ontario.

purposes

(6) The hydro transmission corridor lands shall be reserved for public transit, recreational, infrastructure development and similar public purposes.

Transfer of transmission corridor lands

(7) Her Majesty in right of Ontario may sell, lease or otherwise transfer hydro transmission corridor land to municipalities, public transit corporations and similar entities for public transit, recreational, infrastructure development and similar public purposes and for no other purpose.

Regulations

(8) The Lieutenant Governor in Council may make regulations describing hydro transmission corridor lands.

(9) A regulation made under subsection (8) may be general or particular in its application and may be limited to particular parts of the Province.

Definition

(10) In this section,

"hydro transmission corridor lands" means the lands reserved by Ontario Hydro for hydro transmission purposes and includes the lands more particularly described by regulation made under this section.

Commencement

2. This Act comes into force on the day it receives Royal Assent.

Short title

3. The short title of this Act is the Electricity Amendment Act (Hydro Transmission Corridor Lands), 2002.

EXPLANATORY NOTE

The Bill amends the Electricity Act, 1998 to remove from the assets of Ontario Hydro or its successor the hydro transmission corridor lands, which are to be held by the Province for recreational, public transit and similar purposes.
