An Act respecting the Ontario Association of Certified Engineering Technicians and Technologists
Preamble
The Ontario Association of Certified Engineering Technicians and Technologists has applied for special legislation to re-enact its governing Act (the Ontario Association of Certified Engineering Technicians and Technologists Act, 1984), making changes respecting the objectives, structure and administration of the Association, adding to the list of designations that it is authorized to grant to its members, and describing the work performed by its members. The Association represents that it was incorporated under the laws of Ontario by letters patent dated March 19, 1962 and was continued under the 1984 Act.
It is appropriate to grant the application.
Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
Administration of the Association
Association continued
1. (1) The Ontario Association of Certified Engineering Technicians and Technologists is continued as a corporation without share capital.

(2) The Association is composed of its members.
Objects
2. The following are the objects of the Association:
1. To establish, maintain and conduct an institute or association within Ontario for technicians, engineering technicians, applied science technologists and engineering technologists for the purpose of granting membership and registration to persons who meet the standards of the Association.
2. To maintain discipline among its members.
3. To assist members in advancing their status, recognition and welfare and in increasing their knowledge, skill and proficiency.
4. To establish and maintain consistent registration requirements for technicians, engineering technicians, applied science technologists, engineering technologists and other classes of members.
5. To establish, promote and enforce high ethical and professional standards of conduct for members.
6. To accept donations, gifts, legacies and bequests for use in promoting its objects and carrying on its work.
7. To carry on benevolent work in connection with the families of dead, retired or incapacitated members who are in need.
8. To co-operate with other organizations with objects that are, in whole or in part, the same as or similar to its objects.
Powers
3. The Association has the capacity and the rights, powers and privileges of a natural person.
Council
4. The affairs of the Association shall be managed by its council.
Composition of council
5. (1) The council of the Association is composed of such number of persons as is specified by by-law.

(2) The council shall have a minimum of 12 and a maximum of 24 councillors.

(3) The president, each vice-president, the president-elect and the past president hold office as councillors by virtue of their position.

(4) The following persons must constitute at least two-thirds of the membership of the council:
1. The president, each vice-president, the president-elect and the past-president.
2. Councillors who are elected in accordance with the by-laws.

(5) The remaining councillors are to be chosen in accordance with the by-laws.
Eligibility
(6) The by-laws may specify criteria for determining whether a person is eligible to hold office as a councillor.
Regional representation
(7) The by-laws may provide for councillors to represent regions, and may specify that a member in a region is entitled to vote for his or her regional representative only and not for other representatives.

6. The president, the president-elect and the vice-presidents of the Association are to be elected in accordance with the by-laws.
By-laws
7. (1) The council may make such by-laws as it considers advisable to carry out the objects of the Association and to administer its affairs.
Confirmation
(2) A new by-law or an amendment to a by-law is effective when it is passed by the council but expires at the end of the next annual meeting of the members unless it is confirmed at that meeting.
Public inspection
(3) The council shall make its by-laws available for inspection by the public at its head office during normal office hours.
Membership and Registration
Registration
8. (1) The Association shall register a person as member if the person applies in accordance with the requirements established by the Association and meets the requirements established by the Association for membership.

(2) The Association shall register a member in one or more of the following classes of members, if the member meets the requirements established by the Association for registration in the applicable class:
1. Certified technician.
2. Certified engineering technician.
3. Applied science technologist.
4. Certified engineering technologist.
5. Professional applied science technologist.
6. Professional certified engineering technologist.
Appeal
(3) A person who is refused registration may appeal the refusal in accordance with the by-laws.
Register
9. (1) The Association shall keep a register listing the names of its members in good standing, their class of membership and such other information as the council considers appropriate.
Public inspection
(2) The Association shall make the register available for inspection by the public at its head office during normal office hours.
Use of Designations
Designations
10. (1) A member of the Association who is registered as a certified technician may use the designation "Certified Technician", which may be appreviated as "C.Tech.".

(2) A member of the Association who is registered as a certified engineering technician may use the designation "Certified Engineering Technician", which may be abbreviated as "C.E.T.".

(3) A member of the Association who is registered as an applied science technologist may use the designation "Applied Science Technologist", which may be abbreviated as "A.Sc.T.".

(4) A member of the Association who is registered as a certified engineering technologist may use the designation "Certified Engineering Technologist", which may be abbreviated as "C.E.T.".
Same, P.A.Sc.T.
(5) A member of the Association who is registered as a professional applied science technologist may use the designation "Professional Applied Science Technologist", which may be abbreviated as "P.A.Sc.T.".

(6) A member of the Association who is registered as a professional certified engineering technologist may use the designation "Professional Certified Engineering Technologist", which may be abbreviated as "P.C.E.T.".
Prohibition re designation
11. (1) A person shall not do any of the following things unless the person is registered by the Association as a certified technician:
1. Use the designation "Certified Technician" or its abbreviation "C.Tech." alone or in combination with any other word, name, title, initial or description.
2. Imply or hold out that he or she is a certified technician.

(2) A person shall not do any of the following things unless the person is registered by the Association as a certified engineering technician:
1. Use the designation "Certified Engineering Technician" alone or in combination with any other word, name, title, initial or description.
2. Imply or hold out that he or she is a certified engineering technician.

(3) A person shall not do any of the following things unless the person is registered by the Association as an applied science technologist or as a professional applied science technologist:
1. Use the designation "Applied Science Technologist" or its abbreviation "A.Sc.T." alone or in combination with any other word, name, title, initial or description.
2. Imply or hold out that he or she is an applied science technologist.

(4) A person shall not do any of the following things unless the person is registered by the Association as a certified engineering technologist or as a professional certified engineering technologist:
1. Use the designation "Certified Engineering Technologist" alone or in combination with any other word, name, title, initial or description.
2. Imply or hold out that he or she is a certified engineering technologist.

(5) A person shall not do any of the following things unless the person is registered by the Association as a professional applied science technologist:
1. Use the designation "Professional Applied Science Technologist" or its abbreviation "P.A.Sc.T." alone or in combination with any other word, name, title, initial or description.
2. Imply or hold out that he or she is a professional applied science technologist.

(6) A person shall not do any of the following things unless the person is registered by the Association as a professional certified engineering technologist:
1. Use the designation "Professional Certified Engineering Technologist" or its abbreviation "P.C.E.T." alone or in combination with any other word, name, title, initial or description.
2. Imply or hold out that he or she is a professional certified engineering technologist.

(7) A person shall not use the abbreviation "C.E.T." alone or in combintation with any other word, name, title, initial or description, unless the person is,
(a) a certified engineering technician;
(b) a certified engineering technologist; or
(c) a professional certified engineering technologist.
Offence
(8) A person who contravenes any provision of this section is guilty of an offence.
Description of Work
Description of work
12. (1) The work performed by a certified technician, a certified engineering technician, an applied science technologist, a certified engineering technologist, a professional applied science technologist or a professional certified engineering technologist consists of,
(a) providing technical services within the framework of practices, codes and standards that are established or enforced under an Act of Ontario or of Canada;
(b) providing technical services within the framework of published standards in the applicable industry or field; and
(c) providing technical services under the technical direction of a licensed member of an appropriate profession or, if the services are provided in a field in which there are no licensed professionals, under the technical direction of an expert in the field.

(2) Subsection (1) does not authorize a certified technician, a certified engineering technician, an applied science technologist, a certified engineering technologist, a professional applied science technologist or a professional certified engineering technologist to provide services that, under an Act of Ontario or of Canada, only a licensed member of a profession is permitted to provide.
General
Rights preserved
13. (1) This Act does not affect with the right of a person to describe himself or herself as a technician, an engineering technician, a technologist or an engineering technologist.

(2) This Act does not affect the right of a person to perform the work described in subsection 12 (1).
Repeal
14. The Ontario Association of Certified Engineering Technicians and Technologists Act, 1984 is repealed.
Commencement
15. This Act comes into force on the day it receives Royal Assent.
Short title
16. The short title of this Act is the Ontario Association of Certified Engineering Technicians and Technologists Act, 1998.
