School Class Sizes Act, 1997
EXPLANATORY NOTE
The Bill limits the number of pupils that may be enrolled in a class in a school in Ontario. The limit depends on the grade level of the class.

An Act respecting the number of pupils
that may be enrolled in a school class
Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:
Definitions
1. In this Act,
"school" means a school within the meaning of the Education Act; (école")
"school board" means a board as defined in subsection 1 (1) of the Education Act; ("conseil scolaire")
"special education program" means a special education program within the meaning of the Education Act. ("programme d'enseignement à l'enfance en difficulté")
Maximum enrolment
2. (1) Despite any Act, every school board shall ensure that enrolment in classes in a school do not exceed the following number of pupils:
1. In the case of a class of pupils in junior kindergarten or senior kindergarten, 17 pupils.
2. In the case of a class of pupils in grade 1, 2 or 3, 23 pupils.
3. In the case of a class of pupils in grade 4, 5 or 6, 26 pupils.
4. In the case of a class of pupils in grade 7 or 8, 28 pupils.
5. In the case of a class of pupils in any grade beyond grade 8,
i. for advanced level classes, 29 pupils,
ii. for general level classes, 25 pupils, and
iii. for basic level classes, 20 pupils.

(2) In the case of a class that includes pupils in two or more grades in respect of which different maximum enrolments apply under subsection (1), the maximum enrolment applicable to thelower grade shall apply with respect to the class.
Application
3. This Act does not apply with respect to a class for pupils enrolled in a special education program.
Commencement
4. This Act comes into force on the day it receives Royal Assent.

5. The short title of this Act is the School Class Sizes Act, 1997.
