Debate was resumed on Government Order Number 21, on the amendment to the motion relating to negotiations with the federal government on a comprehensive new agreement to provide funding, planning, and governance for immigrants to succeed and for Ontario to prosper.

After some time, there being no further debate, the question having been put on the amendment to the motion, the Acting Speaker (Mrs. Munro) declared her opinion that the Nays had it, and a recorded vote having been demanded, the Acting Speaker then addressed the House as follows:-

Pursuant to Standing Order 9(c), the vote on the amendment to the motion to Government Order Number 21 is deferred until "Deferred Votes" today.

At 10:05 a.m., the Government House Leader indicated that no further business would be called that morning and therefore the Acting Speaker recessed the House.

The Speaker addressed the House as follows:-

I beg to inform the House that, pursuant to Standing Order 71(b), the Member for Renfrew–Nipissing–Pembroke has notified the Clerk of his intention to file notice of a reasoned amendment to the motion for Second Reading of Bill 140, An Act to enact the Housing Services Act, 2010, repeal the Social Housing Reform Act, 2000 and make complementary and other amendments to other Acts. (Sessional Paper No. 351).

The Order for Second Reading of Bill 140 may therefore not be called today.

The Speaker addressed the House as follows:

I beg to inform the House that I have today laid upon the Table the Annual Energy Conservation Progress Report - 2009 (Volume Two) from the Environmental Commissioner of Ontario entitled, Re-thinking Energy Conservation in Ontario - Results (Sessional Paper No. 350).

“and the federal government to support the integration of newcomers and the economic recovery in Ontario by investing in services for newcomers and therefore asks the federal government to fulfill their commitment under the recently expired five-year Canada-Ontario Immigration Agreement to spend the outstanding” and “promised to Ontario’s newcomers and immediately”

And substitute the words:-

“[A]nd calls on the Provincial Government to support the integration of newcomers and the economic recovery in Ontario by promoting the investment in services for newcomers through a fully costed plan including accountability and performance measures, which will allow the Federal Government to spend the” and “that was not applied for under the existing Canada-Ontario Immigration Agreement and will aid the province in commencing”.

M. Gravelle propose,

That, pursuant to Standing Order 47 and notwithstanding any other Standing Order or Special Order of the House relating to Bill 135, An Act respecting financial and Budget measures and other matters, when Bill 135 is next called as a Government Order the Speaker shall put every question necessary to dispose of the Second Reading stage of the bill without further debate or amendment and at such time the bill shall be ordered referred to the Standing Committee on Finance and Economic Affairs; and

That except in the case of a recorded division arising from morning Orders of the Day, pursuant to Standing Order 9(c), no deferral of the Second Reading vote shall be permitted; and

That the Standing Committee on Finance and Economic Affairs be authorized to meet on Thursday, December 2, 2010 during its regular meeting times for public hearings and be authorized to meet on Monday, December 6, 2010 at 2:00 p.m. for the purpose of clause-by-clause consideration of the Bill; and

That the deadline for filing amendments to the bill with the Clerk of the Committee shall be 10:00 a.m. on Monday, December 6, 2010. At 5:00 p.m. on Monday, December 6, 2010, those amendments which have not yet been moved shall be deemed to have been moved, and the Chair of the Committee shall interrupt the proceedings and shall, without further debate or amendment, put every question necessary to dispose of all remaining sections of the Bill and any amendments thereto. The Committee shall be authorized to meet beyond the normal hour of adjournment for clause-by-clause consideration on Monday, December 6, 2010. Any division required shall be deferred until all remaining questions have been put and taken in succession with one 20-minute waiting period allowed pursuant to Standing Order 129(a); and

That the Committee shall report the bill to the House no later than Tuesday, December 7, 2010. In the event that the Committee fails to report the bill on that day, the bill shall be deemed to be passed by the Committee and shall be deemed to be reported to and received by the House; and

That, upon receiving the report of the Standing Committee on Finance and Economic Affairs, the Speaker shall put the question for adoption of the report forthwith, and at such time the bill shall be Ordered for Third Reading, which Order may be called that same day; and

That, when the Order for Third Reading of the bill is called, 1 hour shall be allotted to the Third Reading stage of the bill, apportioned equally among the recognized parties. At the end of this time, the Speaker shall interrupt the proceedings and shall put every question necessary to dispose of this stage of the bill without further debate or amendment; and

That the vote on Third Reading may be deferred pursuant to Standing Order 28(h); and

That, in the case of any division relating to any proceedings on the bill, the division bell shall be limited to 5 minutes.

A debate arose and after some time, the question having been put, the Acting Speaker (Mrs. Munro) declared her opinion that the Ayes had it, and a recorded vote having been demanded,

The Acting Speaker directed that the Members be called in, for which purpose the division bells were rung.

During the ringing of the bells, the Acting Speaker addressed the House as follows:-

I have received a request from the Chief Government Whip, under Standing Order 28(h), that the vote on Government Notice of Motion Number 51 be deferred until December 1, 2010.

J'ai reçu une requête du Whip en chef du gouvernement, conformément à l'article 28 h) du Règlement, que le vote sur l’avis de motion numéro 51 émanant d’un gouvernement soit différé jusqu'au 1 decembre 2010.

Therefore the vote is accordingly deferred.

The Order of the Day on the motion for Third Reading of Bill 122, An Act to increase the financial accountability of organizations in the broader public sector, having been called, a point of order was raised and the Acting Speaker recessed the House and upon her return delivered the following ruling:-

Earlier today, Bill 122 was reported to the House from a standing committee, with certain amendments.

Pursuant to the time allocation Order passed on November 4, when the report of the committee on Bill 122 was received and adopted, the bill was ordered for Third Reading.

The November 4 time allocation Order also contained a provision that the Order for Third Reading of the Bill could be called on the same day it was reported from committee, and indeed that is what the Government House Leader did a few minutes ago when Orders of the Day was called.

I will say that this precise scenario occurred on January 29, 1996, when Bill 26 was reported to the House. On that same day, Bill 26 was called during Orders of the Day, even though it had been amended but not yet reprinted. The Speaker at that time ruled that it was in order for the debate to proceed. There are other similar instances where time-allocated bills have withstood similar points of order.

I am satisfied that the time allocation Order that the House passed on Bill 122 made clear provision for the ability of the bill to be called in this situation, and I will allow the debate to proceed.

I will now recognize a minister to move Third Reading of the Bill.
