On a point of privilege being raised by the Member for Kingston and the Islands relating to the consideration and approval by the Board of Internal Economy of the Estimates of the Office of the Provincial Auditor, the Speaker delivered the following ruling:- I thank the Member. What he does point out deals with notice provisions in the Audit Act for Board of Internal Economy meetings at which the Estimates of the Provincial Auditor are considered. The issue the Member raises is one of legal interpretation and it is not a matter of privilege. I would be happy to speak to the Member privately about it. For clarification, what section 29(3) of the Audit Act says is that the Chair and the Vice-Chair "shall be" notified of such meetings of the Board of Internal Economy. I have a letter dated May 17 to both the Chair and the Vice-Chair advising you _the Chair_ of this from the Auditor, copied to me. It goes on to say "...the Chair and the Vice-Chair may attend at the Board's review of my office's Estimates ," the operative word being "may". In fact, it was not a separate meeting that was held that night; it was the same Board of Internal Economy meeting that was adjourned for a vote in the House, and then came back and finished up. So there was not a new meeting, it was a continuation interrupted by a vote in the House of the same meeting, and all the Members of the Board of Internal Economy who were there will know that. |
He does raise some valid points and I would certainly be pleased to meet with him and the Members of the Board to discuss the issue further. I do thank him for bringing it to my attention. |
